The Anna Nicole Smith / J. Howard Marshall Case.

The case of Anna Nicole Smith suing for recovery of over $500million from the estate of her billionaire oil magnate husband, J. Howard Marshall, was widely publicized and resulted in the longest trial in Harris County history. Jeff Diamant, and 3 of his former partners, were the handling and trial counsel that represented the Estate of J. Howard Marshall. This team is the team that successfully kept Anna Nicole from ever recovering any money from J. Howard's estate. This litigation, lasting over 10 years of his career, touched issues in a huge array of legal areas, and involved one of the most complicated estates and trials known to date. This litigation involved 2 trials in Harris County, Texas, a second trial in Federal Court in California, and appeals in both Texas and in the 9th Circuit Federal Court of Appeals.

The Brazilian Kidnapping Case.

In the widely publicized Brazilian kidnapping case, Carlos and Jemima Guimaraes, parents of Marcelle Guimaraes and grandparents to Nico Guimaraes, were criminally prosecuted for allegations of conspiring with and aiding their daughter in the alleged international kidnapping of Nico. This wrongful prosecution was brought by Marcelle’s former husband, Dr. Christopher Brann. Continuing to maintain their innocence, the Guimaraes family hired Jeff Diamant, PC who exposed the fraud on the court committed by Brann and Diamant was selected as lead trial counsel to prosecute him for this perpetrated fraud.

Recent commercial litigation result.

Recently, Jeff Diamant handled a commercial litigation matter involving breach of confidentiality agreements, misappropriation of trade secrets and fraud in a business and oil & gas related case. The Plaintiff sued his clients for over $8million and resulted in the dismissal of this action with no financial recovery.

A change in the law regarding arbitration provisions and nursing homes.

Jeff Diamant, P.C. has extensive experience in handling arbitration matters including challenging mandatory arbitration provisions as well has handling arbitrations in a wide variety of litigation matters. In fact, Jeff Diamant was recently successful in challenging a mandatory arbitration provision and avoiding costly arbitration in a nursing home context. This successful challenge was appealed, and interestingly, during the pendency of the appeal, CMS (Center for Medicare Services) passed a new rule prohibiting nursing homes who use arbitration provisions from receiving Federal Medicare funds.

A history of being the counsel of choice for some of the toughest of cases.

Jeff Diamant has an extensive history of handling some of the toughest cases. In his experience, he has handled and been involved in a $1billion estate matter, numerous clear liability personal injury matters involving death or rendering the plaintiff in a vegetative state, matters involving key corporate officers violating non-compete and confidentiality agreements, cross-indemnity agreement cases and many other. In his history, he has been "excess" counsel for AIG, being hired only on the worst of cases, as well as regional counsel for Allied Waste and Waste Management.
